Trademark Registration Abroad

The scope of the right arising from the registration of trademarks is territorial. According to the principle of territoriality, the rights of a person who has obtained a trademark right in a country are only valid within the borders of that country, and in order for the trademark owner to have a valid trademark right in other countries, he/she must also register his/her trademark in the offices of the countries in which he/she requests protection. Therefore, if your trademark is used in a country other than Turkey or if you plan to use it, a trademark registration application must be made in that country or countries as well.

The following methods can be preferred when registering a trademark abroad:

National Trademark Registration Application

In the requested country, as in Turkey, a trademark registration application can be made directly to the relevant Trademark and Patent Office through local trademark attorneys residing in that country.

International Trademark Application Made Through WIPO (World Intellectual Property Organization) Within the Framework of the Madrid Protocol

Application is made through WIPO (World Intellectual Property Organization) by selecting the countries you want from the 115 countries that are members of the Madrid Protocol.

The main advantages of the Madrid Protocol application are as follows:

Ensuring that trademarks are registered in more than one country with a single application and a single language
More economical than national applications
Transactions such as title and address changes that need to be recorded in the registry can be made with a single application rather than in individual countries

*In order to benefit from this application method, your trademark must be registered or have a registration application in Turkey.

*International registration is dependent on the registration you receive in the office of origin, i.e. Turkey, for 5 years. If your registration in Turkey is invalid for any reason within the first 5 years, the international trademark registration will also be invalid.

European Union Trademark Application (EUTM)

It is an application system that provides protection with a single application in all member countries of the European Union. It is a system in which all member countries are accepted as a single country. Therefore, if your trademark is rejected in one of the member countries, the trademark is considered rejected in all countries. Within the scope of the Madrid Protocol, EU countries can be preferred as a single country.

*If the trademark is not used for 5 years without a valid reason after it is registered, it is a reason for cancellation of the trademark.

OAPI System Application in Africa

The OAPI system is an application system valid in African countries whose official language is French. If protection is obtained, the registration is valid in all countries, and the rejection of the trademark in one of the countries causes the trademark to be rejected in all countries.

Within the scope of the Madrid Protocol, OAPI countries can be preferred as a single country.
